These Terms of Service ("Terms") govern your use of the website operated by WEBSOL Digital Solutions and set out the baseline contractual framework for all professional services, web development projects, and SEO engagements. By engaging our services or using our site, you agree to these Terms in full.

1. Services & Statements of Work

WEBSOL Digital Solutions provides bespoke web development, eCommerce solutions, speed optimization, search engine optimization (SEO), and digital consulting. Specific project deliverables, milestone timelines, and costs will be formally documented in a written Statement of Work (SOW) or formal project quotation.

2. Cost Calculator & Estimates

The pricing generated by the online Website Cost Calculator Tool on our website serves as a preliminary non-binding cost estimate based on standard specifications. Final fixed pricing is determined upon detailed requirement analysis and scope confirmation. All prices listed are in New Zealand Dollars (NZD) unless selected otherwise and exclude GST.

3. Intellectual Property & Code Ownership

We firmly believe that clients should own their digital assets. Upon receipt of full and final payment for a completed project:

• Full Ownership: You retain 100% intellectual property ownership of all custom front-end code, website structure, graphics, and content created specifically for your project.
• No Lock-In: There are no licensing restrictions preventing you from hosting, migrating, or modifying your website code with any third-party provider.

4. Payment Terms & Milestones

Unless explicitly agreed upon in writing, standard development projects operate on a milestone-based payment structure (typically 50% deposit upon project initiation and 50% upon client sign-off prior to live domain deployment). Ongoing SEO services are billed monthly in advance.

5. Client Responsibilities

Timely project completion relies on active collaboration. Clients agree to provide required text content, images, brand guidelines, and review feedback within agreed project timeframes to avoid scheduling delays.

6. Warranty & Bug-Fix Period

All custom web development projects delivered by WEBSOL Digital Solutions include a 30-day post-launch warranty period. During this timeframe, any technical defects, responsive layout bugs, or cross-browser inconsistencies identified within the original project scope will be rectified at zero additional charge.

7. Limitation of Liability

To the maximum extent permitted by law, WEBSOL Digital Solutions shall not be liable for indirect, incidental, or consequential damages resulting from third-party server outages, third-party software changes, or algorithmic updates implemented by external search engines (such as Google).

8. Governing Law

These Terms and any project contracts shall be governed by and construed in accordance with the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of the courts of New Zealand.
